Challenging the State’s overbroad claim of exemption from public disclosure of all records related to the EB-5 program.

With co-counsel, we represent the news organization VTDigger in its lawsuit brought under Vermont public records law. VTDigger has requested that the Vermont agency charged with oversight of the EB-5 program disclose seven days’ worth of communications between that agency and U.S. Citizenship and Immigration Services. In this lawsuit, we argue the state cannot block access to all records related to its administration of the EB-5 program without showing how the specific records requested are relevant to separate, ongoing litigation.
